Privacy Statement and Consent to Data Processing for Job Candidates applying through the Taleo system
Any personal data provided or uploaded here in the course of registering voluntarily into National Instruments’s online recruiting system or applying for any open job requisition, including but not limited to personal data provided in applications or their attachments, (hereinafter referred to as “Personal Data”), is recorded and processed by National Instruments, hereinafter: NI, according to the conditions set forth in this statement, for the purpose of storing, evaluating your application, allowing your participation in the recruitment process, and informing you about National Instruments’ other job requisitions relevant for you. The legal ground of the data processing is Your consent.
Your Personal Data is entered into a database located in a secure server supplied by an outside service provider in the USA but shall only be accessible by appropriately authorized employees of NI, who are recruiters as well as managers of the appropriate level of the area relevant to the given job requisition. These employees and managers are prohibited from using the Personal Data for purposes other than those detailed above.
The above referred outside service provider is Oracle Corporation (500 Oracle Parkway, Redwood City, California 94065, USA), who provides the necessary software and database environment, as well as the hosting services which maybe outsourced, to National Instruments’ online recruiting system. Oracle Corporation will only access and process the Personal Data on behalf and under the instructions of NI as data processor for the purpose of IT security and providing IT support.
Taking into consideration that accessing the Personal Data by employees of the above referred US-based corporations qualify as transfer outside of the European Economic Area, and given that according to the European Commission the United States do not provide a level of data protection corresponding that of the European Union, therefore, in addition to the above, we have taken additional measures in order to ensure that your Personal Data be appropriately protected even outside the European Union.
Personal Data is transferred by using at least 265 Bit AES encryption.
An international Data Transfer Agreement has been concluded by NI, which is based upon the model clauses recommended by the European Commission for this purpose, and which guarantees that your Personal Data will be handled by NI in compliance with the EU’s data protection requirements. For similar purposes, the appropriate contractual provisions and assurances have been put in place towards Oracle Corporation, the outside service provider acting as data processor.
Your Personal Data will be stored for the period required by the recruitment procedure, and – in case you do not specifically request the contrary – for an additional 3 years period for the purpose of informing you about job requisitions relevant to you. In case you provide Personal Data in the course of registration without applying for any specific job requisition, such Personal Data will be stored for the above detailed purposes for a period of 3 years. However, if there is eventually a legal dispute between you and National Instruments, the Personal Data will be handled, for the purpose of appropriately resolving the dispute, until such time as the legal dispute is resolved with final effect. In case we are obliged by the relevant statutory requirements, applicable from time to time, to handle your Personal Data beyond the time limits specified above, we will do so. After the relevant time period of the data processing expires, your Personal Data will be anonymized/made inaccessible through the service provider supplying the IT environment.
National Instruments will not disclose the Personal Data to other third parties, unless a final court order, or a decree or information request of a governmental agency or other authority imposes an obligation to do so.
You hereby declare that the Personal Data which you provide here is in all aspects real, accurate, up-to-date and not in any manner deceptive, misleading or inaccurate; furthermore, that you as data subject are authorized to provide such data to NI. You are hereby informed that You have the right to request information, access, rectification, erasure, restriction of processing from National Instruments in connection with the handling and processing of your Personal Data, as well as the right to object to the processing of Your Personal Data. Acceptance of the above detailed terms is a necessary condition for registering in NI online recruitment system and of any application for a job requisition announced by NI .The application, and the required registration, are voluntary.
